We Will Know Soon if the Constitution Still Stands
The Supreme Court has agreed to rule on birthright citizenship
Our Marmalade Mussolini has done too many outrageous and stupid things to count since we put him back in power, but one of the most absurd was his announcement that he was revoking “birthright citizenship,” the principle that any child born in this country, no matter who their parents are, is an automatic citizen of the United States.
The only exception is for any babies born to foreign diplomats stationed here. There are certainly some ambiguous things in the Constitution, but this isn’t one of them. The Fourteenth Amendment says “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.”
That’s about as clear as the doctrine that there are two pints in a quart.
When Trump issued an executive order voiding that, several federal judges, including some appointed by Republican presidents, instantly blocked that order, and a succession of federal appeals courts backed them up. Now, the highest authority in the land, the United States Supreme Court, said it will hear oral arguments on this question in May, which means they will probably rule by the end of June.
If they rule in favor of Trump, it means the Constitution is essentially meaningless, and we will be legally equivalent to the Third Reich, where the Fuhrer was the “supreme law lord.”
My guess and hope is the justices won’t be willing to abolish their own power, except perhaps for the contemptible and corrupt duo of Thomas and Alito, but I’m not sure of much of anything anymore, except that we must never give up or give in.
